PARLIAMENT’S CHALLENGE OF COURT ORDERS


Following the interview made by the Minister of Information Communications and Technology, Senator Winnie Magagula, on the 2nd of October 2012 in connection with the recent Swaziland Post and Telecommunications Corporation/Swazi MTN judgement on the switching off of the mobile telephony of the Swaziland Post and Telecommunications Corporation, the House of Assembly on the 3rd October 2012 moved and passed a motion without notice challenging the decision of the Cabinet to allow SPTC to implement the judgements of the Supreme Court of Swaziland and the International Court of Arbitration, Government wishes to state the following;

 

  1. 1.Parliament is challenging the jurisdiction of the Judiciary and Executive.

 

  1. 2.His Majesty’s Government respects and will continue to respect courts decisions.

 

  1. 3.His Majesty’s Government believes that the motion passed by the House of Assembly is null and void as it seeks to compel Cabinet to defy court orders.

 

 

  1. 4.His Majesty’s Cabinet is and will continue to be in full control of His Majesty’s Government and the nation should remain calm and continue with business as usual.
